Terms of Service

These Terms of Service ("Terms") govern any project, quote, or service booked with LoomaDev ("LoomaDev," "we," "us"), a web development and UI/UX design agency based in Islamabad, Pakistan. By submitting a project enquiry, accepting a quote, or making a payment, you ("Client") agree to these Terms.

1. Services

LoomaDev provides, among other services described on our Services page:

• Figma UI/UX design
• Shopify store development
• WordPress websites and custom plugin development
• Custom Next.js websites and web applications
• Search engine optimization (SEO)
• Ongoing maintenance and support

The exact scope, deliverables, and timeline for your project are agreed in writing (email or a written proposal) before work begins. Any work outside that agreed scope is treated as a change request under Section 4.

2. Quotes & Payment

We agree on a price directly with you before any money changes hands. Most projects are billed in two milestones: an upfront deposit to begin work, and a final payment due when the site is live and you've approved it. Larger or longer-running projects may use additional milestones, agreed in advance.

We accept SadaPay and bank transfer for international clients, and bank transfer, JazzCash, or EasyPaisa for clients in Pakistan. Proper invoices are issued for every payment. Work on the next milestone begins once the current milestone's payment is received.

3. Design & Revisions

We provide unlimited revisions during the design (Figma) phase, before development begins. Once you approve the final design and development starts, further design changes are treated as change requests under Section 4, since they affect code already written.

4. Change Requests & Scope

Requests that fall outside the originally agreed scope, e.g. new pages, features, or a design direction change after development has started, are quoted separately and require your approval before we begin work on them. This keeps timelines and pricing predictable for both sides.

5. Client Responsibilities

To keep your project on schedule, you agree to:

• Provide content (text, images, branding) and feedback in a timely manner
• Respond to design and development reviews within a reasonable time
• Ensure you have the rights to any content, images, or trademarks you ask us to use

Delays in providing content or feedback may extend the delivery timeline accordingly.

6. Intellectual Property

Upon receipt of full and final payment, ownership of the final deliverables (design files, source code, and content created specifically for your project) transfers to you. Until full payment is received, all work remains the property of LoomaDev. We retain the right to showcase completed projects in our portfolio and marketing materials unless you request otherwise in writing.

Third-party assets used in your project, such as stock photography, fonts, plugins, or themes, remain subject to their own licenses.

7. Post-Launch Support & Maintenance

Every project includes 1 month of free post-launch support covering bug fixes related to our original work. After that, ongoing maintenance, security updates, and new feature work are available through our monthly maintenance plans, described on the Services page.

8. Warranties & Disclaimers

We build and test every project across major browsers and devices before launch. Beyond that, the Site and any deliverables are provided "as is." We don't guarantee specific search engine rankings, traffic, or business outcomes, as these depend on many factors outside our control.

9. Limitation of Liability

To the extent permitted by law, LoomaDev's total liability for any claim arising from a project is limited to the amount you paid us for that project. We're not liable for indirect, incidental, or consequential damages, including lost profits or data, arising from your use of the deliverables.

10. Confidentiality

We treat project details, business information, and any credentials you share with us as confidential, and we won't disclose them to third parties except as needed to deliver the project (e.g. to a hosting provider) or as required by law.

11. Termination

Either party may terminate a project with written notice. If you terminate after work has started, you're responsible for paying for work completed up to that point. If we terminate without cause, we'll refund any payment received for work not yet delivered.

12. Governing Law

These Terms are governed by the laws of Pakistan. Any dispute arising from these Terms or a project will first be addressed through good-faith negotiation between the parties.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the latest revision. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
